TERMS & CONDITIONS OF USE

The website iwritefiction.co.uk is owned and operated by Hothouse Partworks Ltd., a company registered in England & Wales under Company Number 9547258.

Before participating in the community features of our site, using any of its content or taking part in a writing competition, visitors are required to read and accept these Terms & Conditions of Use and to read our Privacy Policy.

Visitors are also required to create a username and password, and provide their first name, surname and a valid email address where they can be contacted for the purposes set out in our Privacy Policy. This process is referred to on the site as Sign up.

Course content on the site will be made available to subscribers in a monthly sequence of numbered Parts. Access to those Parts purchased by subscription will continue to be provided after the subscription has been cancelled or has lapsed. However, participation  in the Community area such as entry to competitions, entry to, or commenting on, Challenges, Story Shares and Discussions will be restricted after the subscription has been cancelled or has lapsed.

1. Acceptance of terms

By signing up to our website you signify your agreement to our Terms & Conditions of Use.

2. Privacy Policy

A separate page on the website entitled Privacy Policy sets out important details about how we collect, store and use your personal data. If you do not agree with our Privacy Policy please do not accept the Terms & Conditions of Use and do not continue to use the website.

3. Your account

On signing up to the website you will create a personal account. You are solely responsible for the activity that occurs on your account and you should ensure that you keep your password secure. The email address you provide must be kept up-to-date so that you may be contacted by us if necessary.

4. Restrictions on signing up

(1) We believe that our website is not suitable for people under the age of 16 and so, on signing up, you are asked to confirm that you are aged 16 or over.

(2) Account holders must have a valid email address.

5. Content on the website

There are four forms of content on our website:

(1) Content created by us, or licensed by us for use on our website;

(2) Content created by registered account holders;

(3) Content owned by, or licensed by, and hosted by third parties to which our website is linked (such as news articles or Youtube videos);

(4) Advertising of third party products or services that we have permitted to be introduced onto the website.

6. Content created by us, or licensed by us for use on our website

This content which includes but is not limited to videos, texts, photographs, illustrations, graphics, animations, podcasts, music, software and templates, and the trademarks and logos therein, is either created and owned by, and copyright of, Hothouse Partworks Ltd, the owners of the iwritefiction.co.uk website, or is licensed to Hothouse Partworks Ltd. by a third-party who owns the copyright in that content. This content is provided to you for your personal use and may not be used or adapted for any other purposes, including but not limited to commercial purposes, without our express permission. All rights in this content are reserved.

7. Content created by registered account holders

(1) As a registered account holder you may submit to the website content you have created in the form of texts, illustrations, graphics, personal information, comments or messages. You have sole responsibility for the content you submit.

(2) Before you make any content submission to our website we recommend that you consult carefully our Copyright and Content Policy page which provides clear guidance about what kinds of content we DO NOT allow on our website.

(3) We do not endorse any views, opinions, claims of fact, recommendations or advice expressed in content created by users of the website.

(4) You must ensure that your submissions do not infringe the copyright or other proprietary or privacy rights of any third-party or parties. If your submission contains any material that is the copyright or trademark or other intellectual property right of any third-party you must obtain the written permission or license from that third-party to include the material in your submission.

At our sole discretion, we may permit third-party companies, organisations or agencies to introduce advertising onto our website. (7) You agree not to circumvent, disable or otherwise interfere with any features of the website that are intended to safeguard copyright or personal information.

(3) Hothouse Partworks Ltd. disclaims all warranties, express or implied, statutory or otherwise, concerning your usage of our website and concerning any content on the website irrespective of its source.

(4) The Terms and Conditions of Use, this disclaimer, and any claim based on use of the content on our website, shall be governed by the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the Courts of England.

12. Changes in our Terms & Conditions of Use

From time to time we may need to make changes to our Terms & Conditions of Use. If any changes are made, then we shall alert customers by means of notification on the website and recommend that customers consult the new Terms & Conditions of Use immediately.

13. Assignment

(1) These Terms and Conditions of Use and any rights and obligations therein may not be assigned by the user, but may be assigned by Hothouse Partworks Ltd.

(2) In case of assignment, your information may be transferred to a third-party assign provided that the assign undertakes to use your information for the same purposes as set out in our Terms & Conditions of Use and in our Privacy Policy. We undertake not to provide your personal information to any assign save in accordance with this condition of assignment.

TERMS & CONDITIONS OF PURCHASE

These Terms & Conditions are supplementary to those concerning your use of our website which can be found and consulted above. These Terms & Conditions relate to purchase of individual or multiple Parts of the product iWriteFiction published by Hothouse Partworks Ltd., a company registered in England & Wales under Company Number 9547258.

1. Your purchase order

1.1 Only people aged 16 years and over are permitted to place orders of purchase on our website. If you are under the age of 18 but aged 16 or over your purchase order must be made with the approval of a parent or guardian.

1.2 By placing an order of purchase, you warrant that (i) you are 18 years old or over, or (ii) you are 16 years old or over and approval to place the order of purchase has been given to you by a parent or guardian, and (iii) that you agree to be bound by these Terms & Conditions of Purchase and our Terms & Conditions of Use of the website.

 

2. Prices and payments

2.1 The price of Parts on the website is given in pounds sterling (£) and includes UK VAT.

2.2 Payments can be made via our website. Payments may be made by credit card, debit card, PayPal or Direct Debit.

3. Our liability and warranties to you

3.1 We warrant to you that the content purchased through our website is of satisfactory quality and is reasonably fit for the purpose intended. Save for losses caused by our negligence or fraudulent misrepresentation, any loss you suffer as a consequence of any breach of this warrant is limited to the full purchase price of the affecting content you have purchased.

3.2 We are not responsible for indirect or consequential losses which happen as a side-effect of the main loss or damage you may suffer pursuant to any breach of the warrant given in Clause 3.1 above.

3.3 From time to time, if you have agreed to receive emails from us about iWriteFiction, we may offer related products such as travel, guided tours, lectures, seminars, courses or other experiences which we believe you may be interested in. A waiver by us of any default shall not constitute a waiver of any subsequent default.
